1. Acceptance of Terms

These Terms of Service govern access to and use of MusKent Commerce OS, including websites, dashboards, APIs, automation tools, connectors, and related services operated by MusKent.

By accessing or using the service, you agree to these terms on behalf of yourself or the organization you represent.

2. Service Description

MusKent Commerce OS helps customers connect stores and marketplaces, sync product and order data, operate automations, monitor platform activity, and access analytics, developer APIs, and related commerce infrastructure features.

We may modify, improve, or discontinue features from time to time. Some features may be identified as beta, preview, experimental, or limited release.

3. Accounts and Workspace Responsibility

You are responsible for maintaining the confidentiality of your credentials, managing user access, and ensuring that your workspace configuration is accurate and lawful.

You must promptly notify us if you suspect unauthorized access, misuse, or a security incident involving your workspace.

4. Third-Party Platforms and Connected Services

The service may connect to third-party providers such as Google, TikTok, Shopify, WooCommerce, Meta, Amazon, eBay, Etsy, and other commerce services. Your use of those platforms remains subject to their own terms and policies.

You represent that you have the authority to connect those accounts, grant permissions, and instruct MusKent Commerce OS to process related data on your behalf.

5. Acceptable Use

You may not use the service to:

  • Violate law, platform policies, or the rights of others.
  • Transmit malicious code, abuse APIs, or attempt unauthorized access.
  • Interfere with service integrity, rate limits, availability, or security controls.
  • Process content you do not have rights or permissions to use.
  • Use the service to create competing services through scraping or unauthorized replication.

6. Automation, AI, and Generated Output

The service may generate workflow suggestions, AI-assisted automations, summaries, recommendations, or diagnostic output. You are responsible for reviewing generated output before using it in production or for customer-facing actions.

AI output may be incomplete, inaccurate, or unsuitable for a particular use case. The service is not a substitute for professional legal, financial, compliance, or safety advice.

7. Fees, Plans, and Billing

Paid plans, usage caps, feature access, and billing intervals are described in the service or in an applicable order form. Fees are due according to the agreed plan.

If payment cannot be collected, we may suspend or restrict access to paid features until the account is brought current.

8. Customer Data and Permissions

You retain responsibility for the legality, accuracy, and rights associated with the data you provide or connect. You grant MusKent the limited rights necessary to host, process, transmit, analyze, and display that data to provide the service.

9. Intellectual Property

MusKent Commerce OS, its software, branding, interface design, documentation, and service content are owned by MusKent or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, modify, reverse engineer, resell, or create derivative works from the service.

10. Availability and Support

We aim to operate the service reliably, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, abuse controls, platform policy changes, and infrastructure incidents may affect availability.

Support channels, response expectations, and service commitments may vary by plan or contractual agreement.

11. Suspension and Termination

We may suspend or terminate access if you breach these terms, create security risk, fail to pay applicable fees, misuse integrations, or expose the platform to legal or operational harm.

You may stop using the service at any time. Certain obligations, including payment, confidentiality, intellectual property, and liability limitations, survive termination.

12. Disclaimers

The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

13. Limitation of Liability

To the maximum extent permitted by law, MusKent will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from or related to the service.

Where liability cannot be excluded, our aggregate liability is limited to the amount paid by you for the service during the twelve months preceding the event giving rise to the claim.

14. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the service after updated terms take effect constitutes acceptance of the revised terms.
